1. Acceptance of Terms

By accessing or using this website (“Site”) and/or engaging services provided by Psymple Healthcare & Solutions, LLC (“Psymple Healthcare,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must not use the Site or our services.

2. Scope of Services

Psymple Healthcare provides outpatient behavioral health services, which may include:

• Psychiatric diagnostic evaluations

• Medication management

• Psychotherapy and integrative behavioral health services

• Care coordination and related support services

Services may be delivered in person or via telehealth, subject to clinician judgment, licensure requirements, and patient appropriateness.

3. No Emergency or Crisis Services

The Site and our services are not intended for emergency or crisis care. If you are experiencing a medical or psychiatric emergency:

• Call 911

• Go to the nearest emergency department

• Contact the 988 Suicide & Crisis Lifeline (call/text 988).

We do not monitor website submissions, emails, or portal messages for emergencies.

4. Eligibility & Geographic Limitations

Services are provided to individuals located in jurisdictions where our clinicians are licensed to practice (e.g., Maryland and Washington, D.C.). By using our services, you represent that you are physically located in an eligible jurisdiction at the time of care.

Minors must have a parent/legal guardian provide consent and participate as required by law.

5. Use of the Website

You agree to use the Site for lawful purposes only and not to:

• Transmit false, misleading, or unlawful information

• Attempt to gain unauthorized access to systems or data

• Interfere with Site functionality or security

• Use the Site in a way that violates any applicable law or regulation

6. Clinical Relationship

Use of the Site does not create a provider–patient relationship. A clinical relationship is established only after:

  1. Completion of intake/consent processes, and

  2. Acceptance by a Psymple Healthcare clinician, and

  3. A scheduled and completed clinical encounter.

Information on the Site is for general educational purposes only and is not a substitute for professional medical advice.

7. Appointments, Communication & Response Times

• Appointments may be scheduled via phone, website forms, or third-party platforms (e.g., EHR/patient portal).

• Routine communications (email/portal) are not guaranteed to be secure or monitored in real time.

• Clinical advice is provided only during scheduled sessions.

• We aim to respond to non-urgent communications within a reasonable timeframe but do not guarantee response times.

8. Telehealth Services

By engaging in telehealth, you acknowledge and agree:

• Telehealth uses electronic communications (video/audio) that may carry technology risks (e.g., connectivity issues).

• You are responsible for having a private, secure location and appropriate technology.

• You consent to telehealth consistent with applicable laws and our Telehealth Consent.

• In certain situations, we may recommend or require in-person care.

9. Privacy & Confidentiality

We are committed to protecting your privacy in accordance with applicable laws, including:

  • HIPAA (45 CFR Parts 160 & 164)

  • 42 CFR Part 2 (where applicable for substance use disorder records)

Use of services is also governed by our Privacy Policy/Notice of Privacy Practices (NPP). While we implement safeguards, no system is 100% secure, and you acknowledge inherent risks of electronic communication

10. Payment, Fees & Financial Responsibility

You agree to be financially responsible for all services rendered, including:

  • Copayments, coinsurance, deductibles

  • Non-covered services

  • Missed appointment/no-show or late cancellation fees (per our Financial Policy)

We accept various payment methods (e.g., credit/debit cards, HSA/FSA, and select insurance). Fees are subject to change and will be communicated as required.

Sliding Scale: Limited sliding scale options may be available based on eligibility.

11. Insurance & Billing

  • We may be in-network with certain insurers and pending with others; network status may change.

  • Coverage is not guaranteed; verification of benefits is not a guarantee of payment.

  • You are responsible for any balances not paid by your insurer.

  • We may provide superbills for out-of-network reimbursement upon request.

12. Cancellations & No-Show Policy

We require advance notice for cancellations/rescheduling (see Policy).

Failure to provide adequate notice may result in a late cancellation/no-show fee and may impact ongoing scheduling.

13. Prescriptions & Medication Management

Medication decisions are made based on clinical judgment and standards of care.

We do not guarantee prescriptions and may require follow-up, labs, or coordination with other providers/pharmacies. Controlled substances are prescribed in accordance with federal/state laws and practice policies.

14. Records & Access

Medical records are maintained in accordance with legal requirements.

You may request access or copies consistent with applicable law. Fees may apply where permitted.

15. Third-Party Services

We may use third-party vendors for scheduling, telehealth, billing, or communications. Your use of those services is subject to their terms and policies. We are not responsible for third-party performance or availability.

16. Intellectual Property

All Site content (text, graphics, logos, images, design) is owned by or licensed to Psymple Healthcare and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

17. Disclaimer of Warranties

The Site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee specific clinical outcomes.

18. Limitation of Liability

To the fullest extent permitted by law, Psymple Healthcare shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Site or services. Nothing in these Terms limits liability where prohibited by law.

19. Indemnification

You agree to indemnify and hold harmless Psymple Healthcare and its clinicians, employees, and agents from any claims, damages, or expenses arising out of your use of the Site or violation of these Terms.

20. Termination

We reserve the right to suspend or terminate access to the Site or services for violations of these Terms or for clinical/administrative reasons, consistent with applicable laws and ethical obligations (including appropriate notice and referrals when required).

21. Changes to Terms

We may update these Terms at any time. Changes will be posted with a revised Effective Date. Continued use constitutes acceptance of the updated Terms.

22. Governing Law & Venue

These Terms are governed by the laws of the State of Maryland and applicable federal law. Venue for disputes shall be in a court of competent jurisdiction within Maryland, unless otherwise required by law.
